"It is definitely the first and the last time that we do this."Luggen said neither guests nor locals were happy about the action in the town, situated beneath the famous steeple-shaped Matterhorn mountain."Even though we took a lot of snow away, we could not remove it all completely. Jan 12 (Reuters) - Landry's Restaurants Inc (LNY.N) endedits buyout agreement with Chief Executive Tilman Fertitta asthe company was unwilling to disclose financing terms asrequired by regulators, sending its shares down as much as 43percent. Fertitta had reached an agreement in October to buyLandry's for $13.50 a share, a 36 percent discount to anearlier deal he struck with the company on June 16. The latest deal fell through after Landry's said it couldnot comply with the U.S. Securities and Exchange Commission'srequirement that it disclose certain information from acommitment letter issued by the lenders. The lenders held that any disclosure would be in violationof the terms of the commitment letter, and result in thetermination of their commitments for both the buyout andalternative debt financing. Landry's said it terminated the deal in order to maintainalternative financing for its existing $400 million in seniornotes with the lenders, Jefferies & Co and Wells Fargo FoothillLLC. Landry's, which operates the iconic Golden Nugget Hotel &Casino in Las Vegas and several casual-dining outlets includingLandry's Seafood House, expects the refinancing of its seniornotes to close by the end of February.
